Terms & Conditions - Wholesale

1) Availability

a. All items are offered subject to availability.

b. Vintages will change throughout the year and there is no obligation to give notice of further change.

c. In the event that Private Vines is unable to supply all or part of the products ordered for any reason, it will supply as much thereof as it reasonably can as if such products were the subject of a separate contract. Private Vines shall be under no liability to the Purchaser in respect of those products that it is unable to supply to the Purchaser.

2) Minimum order volume

a. The minimum order is 6 cases of 6 bottles. The order may be mixed.

b. Orders below the quoted minimum are subject to a surcharge of £6 per case, plus a delivery surcharge of £7.50.

3) Pricing

a. All prices are quoted in pounds sterling (GBP), and are per case of 6 bottles unless specified.

b. Standard bottle sizes are 750ml.

c. Prices shown are duty-paid and exclude delivery and VAT.

d. Private Vines reserves the right to alter prices at any time.

4) Payment

a. Invoices are payable within 30 days of the date of the invoice, subject to status.

b. All goods remain property of Private Vines until paid for in full.

c. Cheques returned unpaid will be subject to a charge of £10 per presentation.

5) Overdue accounts

a. We may refuse to make further supplies whilst any accounts remain outstanding.

b. We reserve the right to charge monthly interest at 2% above the base rate of Alliance & Leicester Commercial Bank on overdue accounts.

c. Private Vines shall be entitled to recover the goods in the event of late or non payment. We reserve the right to enter premises where the goods are stored and the use of this right shall not prejudice our other rights or remedies.

6) Delivery

a. Delivery is free for orders over the minimum order threshold within a 30 mile radius of MK44 3HU. UK mainland deliveries outside of this area are subject to a minimum delivery charge of £15.00.

b. Wine is normally delivered within 5 working days of receipt of an order.

c. If a delivery time is quoted by Private Vines or its delivery agents, Private Vines or its delivery agents shall incur no responsibility should such a delivery not take place at the quoted time or date. No responsibility can be taken by Private Vines for late or early deliveries, or consequences thereof.

d. Notwithstanding Private Vine’s retention of title, the goods are held at the Customer’s risk upon delivery.

e. Claims for non delivery of goods must be made in writing within 7 working days of receipt of an invoice or despatch note.

7) Damaged bottles

a. Claims for damaged or missing bottles can only be considered if recorded and signed for on the delivery note at the time of delivery.

b. All packaging/breakages must be retained for inspection in the event of any claims, which should be made within 7 working days of receipt of goods.

8) Return of goods

a. The customer may return goods supplied by Private Vines, providing the goods are still in a saleable state.

b. All wine returned to Private Vines will be charged carriage at a rate of £7.50 per case or part thereof.

9) Acceptance of terms

a. Receipt of orders will constitute acceptance of these terms which are in addition to and should be read in association with other terms which may be issued from time to time.
